• For users located in the EEA or UK:
Where the recipient jurisdiction is not recognized as providing an adequate level of protection under Article 45 of the GDPR / UK GDPR (“Adequate Jurisdiction”), and no exemption or derogation under Article 49 applies (e.g., transfers necessary to establish, exercise, or defend legal claims), we will transfer your Personal Data on the basis of:
(a) Standard Contractual Clauses (SCCs) adopted by the European Commission for EEA transfers, or the International Data Transfer Agreement (IDTA) for UK transfers; and
(b) A Transfer Impact Assessment (TIA/TRA) conducted in accordance with applicable law; and

10 Security and Retention of Your Data
We have implemented appropriate technical and organizational security measures designed to protect your Personal Data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, unauthorized access, and other unlawful or unauthorized forms of Processing, in accordance with applicable law.
Because the internet is an open system, the transmission of information via the internet is not completely secure. Although we will implement all reasonable measures to protect your Personal Data, we cannot guarantee the security of your data transmitted to us using the internet – any such transmission is at your own risk and you are responsible for ensuring that any Personal Data that you send to us are sent securely.
We generally retain your information for as long as it is necessary to serve the purpose(s) for which such information was collected, including to provide you with the Services. After you have terminated your use of our Services, we may store your information in an aggregated and anonymized format. Notwithstanding the foregoing, we may also retain any information as reasonably necessary to comply with our legal obligations, to allow us to resolve and litigate disputes, and to enforce our agreements.
Photos, Inputs and Outputs. If you do not place an order, we do not retain your photos, Inputs or Outputs after your design session ends. If you place an order, we retain the photos, Inputs and Outputs associated with that order until the order is completed, meaning the end of the thirty (30) day after-sales period following delivery, so that we can produce and ship your product and handle any after-sales request. We then permanently delete them, unless we are required by law to retain them for longer or need them to establish, exercise or defend legal claims. We require our AI model provider not to retain your photos and Inputs longer than necessary to generate your design.
